1. Acceptance of Terms

By downloading, installing, or using Pawscription, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the application.

These Terms, together with our Privacy Policy and GDPR Declaration, constitute the entire agreement between you and Pawscription regarding the use of Pawscription.

2. Medical Disclaimer

This is critically important: Pawscription is an organizational, record-keeping, and reminder tool. It does not provide, under any circumstances, veterinary diagnosis, treatment, or medical advice. All information about dosages, frequencies, or correct application of any product must come from your certified veterinarian.

We disclaim all liability arising from overdoses, critical missed doses, or any health issue affecting your pet as a result of data entry errors or the use of this application. Always consult your veterinarian before modifying any treatment.

3. License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Pawscription for your personal or family use. The app is provided on an "As-Is" and "As-Available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You may not sublicense, sell, or distribute the application or any part thereof.

4. Intellectual Property

Pawscription, its logo, design, user interface, and source code are the intellectual property of Pawscription. All rights reserved. You may not copy, modify, distribute, decompile, reverse engineer, or create derivative works from any part of the application without prior written consent.

All trademarks, service marks, and trade names used in the app are the property of their respective owners.

5. Your Data

You retain full ownership of all data you create within Pawscription. Since the app operates entirely offline and we have no server infrastructure, we do not have access to, process, or store any of your data.

You are solely responsible for maintaining backups of your data. Data lost due to device failure, accidental deletion, or app uninstallation cannot be recovered by us.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Pawscription and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from the use or inability to use the application.

Our total aggregate liability for any claims arising from or related to the use of Pawscription shall not exceed fifty euros (€50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

7. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. For material changes, we will provide notice through the app or via our website at least 30 days before the changes take effect.

We may also modify, update, or discontinue features of the app at any time. Since Pawscription is an offline application, the version you have downloaded will continue to function on your device, though you may not receive future updates if the project ceases.

8. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms shall be submitted to the jurisdiction of the courts of Barcelona, Spain, unless otherwise required by applicable mandatory consumer protection laws of your country of residence.

EU residents: You may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes online.

9. General Provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent.
